General booking conditions for credit card payment

 

The Yates Azimut booking system is a transaction facilitator to make boat bookings faster than transfers. Any reservation or order implies the obligatory acceptance by the Customer of these general conditions.

Definitions :

The terms mentioned below have, in these general terms and conditions, the meaning set forth in this definition section.

Tenant or Customer The ship’s tenant

Making and validating a reservation

To place an order, the renter must make a request and identify himself beforehand, either by e-mail, telephone or through Yates Azimut’s online quotation request system. After each completed application, Yates Azimut will send you a link to make the corresponding payment.

The validity of the rental contract is subject to the customer’s prior acceptance of these general booking conditions. However, with respect to the particular needs of the booking, the simple written agreement commits the parties to enter into a contract on the basic points of the contract: price, dates, place and embarkation.

Upon registration of your order, Yates azimut will send an email confirming the order to the customer. By saving this email and printing it, the customer will have proof of his order.

 

Payment methods :

Reservation: By credit card (VISA and MasterCard are accepted, excluding American Express). For payment by credit card, Yates Azimut does not apply any additional fee or surcharge.
Rest of payment. At the time of departure .

 

Termination by the lessor

In the event that, as a result of damage suffered during the previous rental period or any other impediment, the lessor is unable to deliver the boat on the agreed date, Yates Azimut undertakes to make available to the renter a boat of equal or greater size and with the same number of moorings or, failing that, to return the sums paid by the renter without the latter being entitled to claim any compensation whatsoever. This reimbursement will be made in proportion to the number of days corresponding to the loss of use.

 

In any case, any service not consumed by the tenant for whatever reason cannot give rise to any refund. In addition, in case of cancellation of the service by Yates Azimut , the renter will be fully reimbursed for the amount of his order without being able to claim damages.

 

 

Article 12: Personal information

12.1. The data collected are intended for the processing of your order by Yates Azimut services. Financial data is used only for billing and booking purposes. In order to process your order, Yates Azimut shares certain information with lessees or other service providers. However, Yates Azimut only communicates information that is essential for the development of the voyage project. Yates Azimut does not trade in customer files or confidential information.

12.2. The customer has a right of access and rectification of the data concerning him/her, which can be exercised by contacting Yates Azimut , in particular via the e-mail address: Yates Azimut[@]Yates Azimutcom . You may also, for legitimate reasons, object to the processing of your personal data.

Article 13: Litigation

The Tenant and the Landlord expressly agree to attempt to resolve amicably any dispute that may arise between them. If no amicable agreement is reached on disputes between the parties to the charter contract, both parties agree to submit any dispute to the competent courts of the country where the cruise took place. Disputes related to this reservation contract must be submitted to the Company’s Court.
